Welcome to Auntie House of Plants. These Terms of Service ("Terms") govern your access to and use of our website at www.auntiehouseofplants.com (the "Site") and any order you place with us. By browsing the Site or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

1. Acceptance of Terms

By visiting the Site, placing an order, or contacting us, you confirm that you have read, understood, and agree to these Terms, together with our Privacy Policy, Payment Policy, Shipping Policy, and Refund & Return Policy, which are incorporated into these Terms by reference. We may revise these Terms at any time; the "Last updated" date reflects the most recent changes. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.

3. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to place an order on the Site. By placing an order, you represent that you meet this requirement and that the information you provide is accurate, current, and complete.

4. Products & Descriptions

We offer a curated selection of live plants for sale through the Site. Because each plant is a living organism, natural variation in size, foliage color, shape, and appearance is expected. The plant you receive may differ slightly from the product photos due to season, growing conditions, and individual growth patterns.

We make reasonable efforts to display accurate descriptions, photographs, and availability. However, we do not guarantee that descriptions, images, pricing, or other content on the Site are always accurate, complete, or current. Availability is not guaranteed; items may sell out or be discontinued at any time.

5. Pricing & Payment

All prices are listed and charged in United States Dollars (USD). The total shown at checkout is final and includes free shipping. We do not add processing fees, service charges, or other hidden costs after you reach the checkout page.

We accept Visa, Mastercard, American Express, and Discover. Payments are processed through PCI-DSS compliant payment providers; we do not collect or store your full card number on our servers. For full details, see our Payment Policy.

We reserve the right to correct any pricing error — even after an order confirmation has been sent — and to cancel the order and issue a full refund in such cases.

6. Order Acceptance & Confirmation

All orders placed through the Site are subject to acceptance and availability. An order confirmation email acknowledges that we have received your order; a binding sale is formed when we send you a shipping confirmation. We reserve the right to refuse or cancel any order at our discretion, including for suspected fraud, verification failures, stock shortages, or pricing errors, in which case you will receive a full refund.

7. Order Modifications & Cancellations

You may request changes to or cancel an order within 24 hours of purchase, provided fulfillment has not begun. Email info@auntiehouseofplants.com with your order number. After this window, or once an order has entered fulfillment, edits may no longer be possible. If the package has already shipped, returns are handled under our Refund & Return Policy.

8. Shipping & Delivery

We ship only to addresses within the contiguous United States. We do not ship internationally or to APO/FPO/DPO addresses, Alaska, Hawaii, or U.S. territories.

  • Free shipping on all orders, with no minimum purchase required
  • Handling time: 1–3 business days
  • Daily cut-off: 5:00 PM Pacific Time
  • Estimated delivery: approximately 4–7 business days after shipment

Full shipping terms — including live plant packaging, tracking, delivery attempts, delays, and lost parcels — are set out in our Shipping Policy. Delivery estimates are not guaranteed; carrier delays and circumstances beyond our control may extend them.

9. Returns, Refunds & Exchanges

We want you to love what arrives at your door. If something isn't right, we'll make it right.

  • You may request a return within 30 days of the delivery date.
  • Condition: to be accepted, a return must be in the same condition you received it, with its original packaging, tags, and labels intact. Live plants must remain in their original nursery container and may not be repotted or removed from the grow pot.
  • Damaged, unhealthy, or incorrect plants must be reported within 7 days of delivery with photographs (see our Refund & Return Policy).
  • Approved refunds are issued to your original payment method; return shipping is free for authorized returns.

The following are not eligible for return or refund:

  • Live plants that have been repotted, planted in the ground, or removed from their original container
  • Damage or decline caused after delivery by improper care or failure to follow included care instructions
  • Plants that perished because the package was not picked up promptly after the delivery notification
  • Returns requested after the 30-day window or reported more than 7 days after delivery
  • Items returned without their original packaging, tags, or labels

10. Plant Care & Condition on Arrival

Live plants require appropriate light, water, and temperature conditions after arrival. Auntie House of Plants is not liable for plants that decline due to improper care, exposure to extreme temperatures after delivery, or failure to follow the care instructions included with your order. Please inspect your plants on arrival and report any concerns within the timeframes described in our Refund & Return Policy.

11. Intellectual Property

All content on the Site — including text, logos, product photos, graphics, and site design — is owned by or licensed to Auntie House of Plants and is protected by copyright, trademark, and other intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from our content without prior written permission.

12. Prohibited Uses

You agree not to use the Site to:

  • Violate any applicable law or regulation
  • Attempt to gain unauthorized access to the Site, our systems, or other users' information
  • Interfere with or disrupt the Site (including introducing malware or conducting denial-of-service attacks)
  • Scrape, harvest, or misuse product data, pricing, or customer information
  • Place fraudulent, speculative, or bulk orders
  • Infringe our or any third party's intellectual property rights

We may suspend or terminate access for anyone who violates these provisions.

13. Limitation of Liability

To the maximum extent permitted by law, Auntie House of Plants shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or related to your use of the Site or any order placed through it. Our total liability for any claim shall not exceed the amount you paid for the order giving rise to the claim. Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by law.

14. Disclaimer of Warranties

The Site is provided on an "as is" and "as available" basis. To the extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components.

15. Indemnification

You agree to indemnify and hold harmless Auntie House of Plants, its owners, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your misuse of the Site, your violation of these Terms, or your violation of any law or third-party right.

16. Governing Law & Disputes

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles. Any dispute arising from these Terms or any order shall first be addressed through good-faith negotiation via info@auntiehouseofplants.com. If unresolved, the dispute shall be brought exclusively in the state or federal courts located in New York, New York, and you consent to their jurisdiction.

17. Severability & Waiver

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. Our failure to enforce any right or provision shall not constitute a waiver of that right or provision.

18. Entire Agreement

These Terms, together with our Privacy Policy, Payment Policy, Shipping Policy, and Refund & Return Policy, constitute the entire agreement between you and Auntie House of Plants regarding the Site and any order placed through it, superseding any prior agreements or understandings.
